MESME Online Food Delivery Service Terms and Conditions of Use for Customers

Welcome to MESME Online Food Delivery Service. These Terms and Conditions of Use ("Terms") govern your use of the MESME mobile application and website (collectively, the "Platform") and the services offered by MESME Online Food Delivery Service. By accessing, browsing, or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Platform or services.
GENERAL TERMS
• Acceptance of Terms: These Terms constitute a legally binding agreement between you and MESME Online Food Delivery Service. Your use of the Platform signifies your acceptance of these Terms.
• Service Description: MESME Online Food Delivery Service provides a technology platform that facilitates the ordering of food from various partner restaurants ("Partner Restaurants") and arranges for the delivery of these orders to you through independent third-party delivery partners ("Delivery Partners"). MESME Online Food Delivery Service is an intermediary and is not a party to the contract for the sale of food between you and the Partner Restaurant.
• Eligibility: You must be at least 18 years of age to use the Platform. By using our services, you represent and warrant that you are of legal age and have the legal capacity to enter into this agreement.
• Modifications: MESME Online Food Delivery Service reserves the right to modify, amend, or change these Terms at any time without prior notice. The updated Terms will be posted on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the revised Terms.
USER ACCOUNT AND REGISTRATION
• Account Creation: To place an order, you must register for a user account on the Platform. You agree to provide accurate, complete, and current information as requested during the registration process.
• Account Security: You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify MESME Online Food Delivery Service immediately of any unauthorized use of your account.
• Prohibited Use: You agree not to use your account for any fraudulent, illegal, or unauthorized purposes. MESME Online Food Delivery Service reserves the right to suspend or terminate your account if we suspect any violation of this clause.
ORDERING AND PAYMENT
• Order Placement: All orders placed through the Platform are subject to the Partner Restaurant's availability and confirmation.
• Pricing and Charges: Prices displayed on the Platform are determined by the Partner Restaurant. In addition to the food price, your final order total may include a delivery fee, a service charge, packaging fees, and applicable taxes. You agree to pay all charges incurred under your account.
• Payment Methods: You can pay for your orders using the accepted payment methods listed on the Platform, including credit/debit cards, digital wallets, and cash on delivery (where available).
• Order Confirmation: Upon placing an order, you will receive a confirmation. This confirmation signifies that the Partner Restaurant has accepted your order.
• Cancellation Policy: You may cancel an order within a specific time frame, typically before the Partner Restaurant has started preparing the food. The exact cancellation policy and any associated fees will be displayed on the Platform. Once the Partner Restaurant has started preparing your order, you will not be able to cancel it, and no refund will be issued.
DELIVERY OF ORDERS
• Delivery Partner: Your order will be delivered by a Delivery Partner. You acknowledge that MESME Online Food Delivery Service is not the employer of the Delivery Partners and is not liable for their actions or omissions.
• Delivery Time: The delivery time provided is an estimate only and is not a guarantee. Delivery times may vary due to factors beyond our control, such as traffic, weather conditions, and unforeseen circumstances.
• Accurate Information: You are responsible for providing a complete and accurate delivery address and contact information. If the Delivery Partner is unable to deliver the order due to an incorrect or incomplete address, or if you are not available at the provided contact number, the order may be canceled, and you may not be entitled to a refund.
CANCELLATIONS, REFUNDS, AND GRIEVANCES
• Incorrect or Missing Items: If you receive an order with incorrect or missing items, you must immediately report the issue to our customer support team. We will investigate the matter and may, at our sole discretion, offer a partial refund, a re-delivery, or a credit to your account.
• Food Quality and Safety: The Partner Restaurants are solely responsible for the quality, safety, and hygiene of the food they prepare. MESME Online Food Delivery Service assumes no liability for any food-related issues, including but not limited to food poisoning or allergic reactions.
• Refunds: Refunds, where applicable, will be processed according to our internal policy and may take several business days to be credited back to your original payment method.
RESTRICTIONS ON USE
• Prohibited Actions: You agree not to:
o Use the Platform for any unlawful purpose.
o Interfere with or disrupt the operation of the Platform.
o Attempt to gain unauthorized access to any part of the Platform or its servers.
o Misrepresent your identity or provide false information.
o Engage in any abusive, harassing, or disrespectful behavior towards Partner Restaurant staff or Delivery Partners.
INTELLECTUAL PROPERTY
• Ownership: The Platform, its content, software, and all intellectual property rights therein are the sole property of MESME Online Food Delivery Service or its licensors.
• License: You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Platform for your personal, non-commercial use, subject to these Terms.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
• Disclaimer: The Platform and services are provided "as is" and "as available," without any warranties of any kind, whether express or implied. MESME Online Food Delivery Service does not guarantee that the Platform will be free of errors, secure, or available without interruption.
• Limitation of Liability: To the maximum extent permitted by law, MESME Online Food Delivery Service, its affiliates, and its employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Platform or services. In no event shall our total liability to you for all damages, losses, and causes of action exceed the total amount you have paid to us for the order in question.
GOVERNING LAW AND JURISDICTION
• Governing Law: These Terms shall be governed by and construed in accordance with the laws of India. • Dispute Resolution: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
